Hopetrip services refer to the products and services provided to you by Hopetrip when you access this website or purchase or use Hopetrip products or services on this website, use Hopetrip's mobile client, or use software provided by Hopetrip related to any of the foregoing.

1.2 This Terms of Use signed between you and Hopetrip does not fully list and cover all your rights and obligations with Hopetrip, and the existing agreements cannot guarantee full compliance with future development needs. Therefore, all additional terms and rules related to the services, as well as Hopetrip's privacy policy ("Privacy Policy"), are supplementary agreements to this Terms of Use, inseparable from this Terms of Use, and have the same legal effect. Your use of Hopetrip services constitutes your agreement to the above supplementary agreements.

3 Using the Service

3.1 User Qualification

3.1.1 You acknowledge that before you begin registering to use Hopetrip services, you must possess the civil capacity appropriate to your actions as stipulated by the laws of the People's Republic of China. If you do not possess the aforementioned civil capacity appropriate to your actions, you and your guardian shall bear all consequences arising therefrom in accordance with the law. Furthermore, you must ensure that you are not subject to any trade restrictions, economic sanctions, or other legal restrictions imposed by any international, regional, or international organization, and that you have not directly or indirectly provided funds, goods, or services to the signatory; otherwise, you should cease using the Hopetrip service.

3.2 Use of the Service

3.2.1 Under these Terms of Use, the services you select on this website are for your personal use only and may not be provided to any third party for use or to obtain any benefit from. The term "service" includes, but is not limited to, accessing this website and using any services provided on this website by Hopetrip itself or on behalf of other operators.

3.2.2 You fully understand and agree that, except as otherwise provided in this Agreement, due to the special nature of online services, Hopetrip may change, interrupt, or partially or completely change its online services without any liability, but Hopetrip will provide prior notice whenever possible.

3.2.3 You fully understand and agree that this service involves internet and mobile communication services, and Hopetrip cannot guarantee that it will not be affected by unstable factors at various stages. Therefore, hopetrip shall not be liable for any losses incurred due to service interruptions, cancellations, or terminations caused by force majeure, computer viruses or hacker attacks, system instability, user location, user shutdown, GSM network, internet network, communication line issues, or other reasons beyond hopetrip's predictability or control.

4. Ownership and Intellectual Property

4.1 User-Uploaded Materials

4.1.1 Once you accept this agreement, you grant hopetrip an irrevocable, worldwide, sublicensable, and exclusive license to use all legal rights and interests related to the following content you provide, upload, create, or publish on this website: text, comments, images, photos, videos, audio, etc. (including but not limited to customer reviews, customer inquiries, and various topic articles). This license is valid until the expiration of the protection period. Hopetrip also has the right to collect evidence and initiate legal proceedings against third parties for any infringement, including but not limited to: the right of reproduction, distribution, rental, exhibition, performance, projection, broadcasting, communication to the public via information networks, filming, adaptation, translation, compilation, and other licensable rights that should be enjoyed by the copyright owner. You agree that hopetrip has the right to store, use, copy, revise, edit, publish, display, translate, distribute, promote, publish, distribute, and disseminate the above information content via information networks, and has the right to adapt and create derivative works, and incorporate the above information into other works in any known or hereafter developed form, media, or technology.

5. User Declarations, Warranties, and Undertakings

5.1 Use of this Website and Services

5.1.1 You represent, warrant, and undertake to hopetrip that you will not provide any user information to any third party, or use this website or services in the following ways:

(d) Participating in commercial activities and/or sales, such as contests, lotteries, transactions, advertising, or marketing, without the prior written consent of hopetrip;

(e) Defaming or impersonating any individual or legal entity, including but not limited to any employee or representative of hopetrip; or

(f) Containing viruses, Trojans, worms, "time bomb" viruses, or other harmful computer code, files, or programs.

5.2 Responsibility for User-Submitted Materials

(d) publish or transmit content intended to obtain or encourage others to obtain the passwords, accounts, or personal data of other users of this website; or

(e) violate any computer network security rules, crack passwords or encrypted codes, transmit or store illegal materials (including materials that may be considered coercive or obscene), or engage in any expressly prohibited illegal activities;

(f) Running maillists, listserv, or any other form of automated reply program or spam on this website, or executing or launching any program when you are not logged into this website, or otherwise interfering with the normal operation of the website's infrastructure, or placing an unreasonable burden on the website's infrastructure; or

6. Account Registration and Security

6.1 Registering a Hopetrip Account

6.1.1 During the use of the services, you may need to register and maintain a Hopetrip account (hereinafter referred to as "hopetrip account") on this Hopetrip website to become a member. You have legal rights and responsibilities for all activities, actions, and events conducted through your account, and you may not transfer your account, authorize others to use your account, or trade with others using your account in any form.

6.2 Providing Personal Information

6.2.1 Based on the terms of use of some services, you may need to set a password and username (hopetrip user ID) on this hopetrip website. If you log in through a third-party website or service, hopetrip may require your hopetrip user ID to match your username on the third-party website or service. Please keep your password safe and do not disclose it to others. You are solely responsible for any losses caused by improper password protection. Due to the special nature of online services, hopetrip has no obligation to verify whether you are the one using the username and password. Even if you believe that your account login was not performed by you, hopetrip will not be liable for any consequences arising therefrom.

6.2.2 You must provide hopetrip with accurate, complete, and up-to-date user information. Failure to provide such information will be considered a violation of these Terms of Use and may result in termination of your hopetrip account.

6.2.3 You represent that you shall never:

(a) choose or use another person's name as your Hopetrip User ID in an attempt to impersonate that person; or

(b) use a name that only another person is authorized to use as your Hopetrip User ID without authorization.

6.2.4 Hopetrip reserves the right to refuse registration or cancel your Hopetrip account.

7. Reviews

7.1 To complete your order, you agree to receive booking confirmation notifications (email and/or mobile app notifications) and agree to receive email or mobile app notifications inviting you to complete an activity review after completing your activity order. You may choose whether or not to complete this review. Order confirmation notifications and activity review invitations are part of the booking process and are not part of advertising or marketing. Completed user activity reviews will be uploaded to the relevant activity page on the Hopetrip platform within 72 hours to inform (future) users of your opinion on the service (level) and quality of the activity. Upon completion of the review, your account will receive Hopetrip points, which can be used for future activity bookings subject to the terms and conditions. Regardless of whether you successfully book one or multiple activities, each account can only post one review per month. If any account is found to have gained points through fraud or abuse, hopetrip may deduct points directly from the hopetrip account without prior notice.

7.2 By posting a review, you grant hopetrip a complete, perpetual, free, transferable, and irrevocable right to all user content. hopetrip has the right to edit, adjust, refuse to use, or delete relevant content at its sole discretion.

7.3 You acknowledge that you will comply with the user review guidelines and represent and warrant that:

7.3.1 You own all rights to the content you post or otherwise have control over the relevant rights;

7.3.2 The content is accurate and not misleading; and

7.3.3 The use, publication, or other dissemination of this content does not violate the Terms of Use or any applicable laws and regulations, will not infringe upon the rights of any third party, and will not cause any harm to any third party.

7.6 User-submitted content is non-confidential information, and hopetrip has no obligation to treat such content as proprietary material. Furthermore, hopetrip reserves the right to use the content appropriately, including but not limited to deletion, editing, and modification.

Publication is not accepted or refused. hopetrip has no obligation to pay you any fees for the content you submit, nor is it obligated to provide you with the opportunity to edit, delete, or change published content once submitted. hopetrip has no obligation to grant you attribution rights to this content, nor is it obligated to enforce third-party attribution rights.

8. Order Confirmation, Tickets, Vouchers, Fees, and Payment

8.1 Order Confirmation

8.1.1 Certain designated activities or services accept instant confirmation. For any other activities or services, any confirmation times stated on this website are for reference only. Actual confirmation times may vary depending on the specific circumstances.

8.2 Purchase and Use of Vouchers

8.2.1 Your booking of services provided by destination suppliers through this website can be confirmed in the form of an electronic voucher (hereinafter referred to as the "Voucher"). Subject to the terms and conditions of the relevant supplier, you will receive an email confirming your order, which will contain a confirmation code for the voucher (hereinafter referred to as the "Confirmation Code") and a printable version of the voucher.

8.2.2 To use your voucher, you must arrive in person at the designated meeting point specified by the relevant supplier on time and provide any documents and/or information that the supplier may require, which may include your confirmation code and/or a printed voucher. If you fail to arrive on time or fail to provide the necessary documents and/or information, you will not receive the service or a refund.

8.2.3 The supplier may require you to provide photo identification documents before allowing you to use your voucher. You should keep your voucher and confirmation code safe. You acknowledge and agree that neither hopetrip nor the supplier will be liable for any loss, damage, or theft of your voucher or confirmation code. Furthermore, the voucher will be invalid if providing the relevant service is prohibited by law. If you attempt to redeem your voucher in an illegal manner (such as attempting to attend a wine tasting event but being underage to use the service), the relevant supplier may refuse to accept your voucher without arranging a refund.

8.3 Voucher Terms of Use

8.3.1 Terms of use may vary for each voucher and may differ from provider to provider. Any restrictions on the voucher (including but not limited to minimum age requirements) will be communicated to you at the time of booking.

8.3.2 The voucher is a one-time admission ticket to the project (hereinafter referred to as the "Project"). The validity period will be specified on the voucher. If you do not use the voucher within the validity period specified on the voucher, a refund will not be issued unless otherwise expressly stated on the voucher.

8.4 Voucher Cancellation

8.4.1 You may cancel your voucher by contacting a Hopetrip customer service advisor within the cancellation period specified on the website at the time of booking. The contact information for cancellation varies on a case-by-case basis. Upon successful cancellation and receipt of the necessary notification, the amount will be fully refunded to the original payment method used during booking.

8.4.2 The final service provider for the Project is the provider, not Hopetrip. The provider has the right to independently accept or refuse any of your vouchers and is responsible for providing all related services.

8.4.3 If you have any questions or complaints about the services offered with this voucher, please contact the relevant supplier. Unless expressly stated in these Terms of Use, all fees paid for vouchers are non-refundable. The booking price is determined based on the interest rate stated on the website on the date of booking.

8.4.4 If your booking is cancelled by the relevant supplier, hopetrip will notify you as quickly as possible and will refund the full amount to the original payment method used at the time of booking.

8.5 Requesting Assistance

8.5.1 If you attempt to redeem a voucher under these Terms of Use and the applicable conditions of use but are unsuccessful (due to supplier responsibility or other reasons), please contact hopetrip at support@hopetrip.com. Hopetrip will attempt to contact the supplier to seek negotiation.

8.6 Additional Charges

8.6.1 hopetrip reserves the right to request payment from you for any services provided. You are responsible for paying all fees due for the services you choose, as explained on this website.

8.7 Fee Changes

8.7.1 Hopetrip reserves the right to change prices and fees at any time. Changes may be sent via email or posted on this website. Your continued use of the service after receiving such notification of changes signifies your agreement to and acceptance of the revised prices and fees.

8.8 Hopetrip's Rights and Obligations

8.8.1 Hopetrip reserves the right to refuse or cancel any service order or booking that may violate these Terms of Service.

8.8.2 Hopetrip strives to provide or negotiate with suppliers the best prices in the market. You acknowledge and confirm that the aforementioned best prices explicitly do not include all taxes or additional fees for the service.

8.8.3 Although Hopetrip requires suppliers to provide accurate and up-to-date service prices, Hopetrip cannot guarantee that the service prices provided by suppliers will be accurate at all times.

8.9 The above Terms of Use and Refund Policy apply to Hopetrip users worldwide.

9. Discounts

9.1 Hopetrip Points

9.1.1 Hopetrip Points are a membership reward system (defined below) that can be accumulated in your Hopetrip account and used within a specified period. Hopetrip Points have no monetary value. Hopetrip Points are earned through booking and participating in non-refundable activities on the Hopetrip platform. Point values vary depending on the individual product and promotion. Every 100 (100) Hopetrip Points awarded is worth HKD 1.00. The exchange rate for these Points is calculated based on the exchange rate used by the Hopetrip platform on the day of redemption. Accumulated Points can be redeemed for any product on the Hopetrip platform or deducted from your total spending.

9.1.2 Hopetrip points can be earned in the following ways, but the number of points earned per booking may vary. Hopetrip reserves the right to make the final decision on point calculation and award:

(a) Points earned after successfully booking and participating in an activity on the Hopetrip platform.

(b) Points awarded by authorized personnel of Hopetrip in any way.

(c) Points earned after completing an activity booked on the Hopetrip platform and submitting a valid review of that activity. To avoid disputes, Hopetrip points can only be redeemed through the Hopetrip platform.

9.1.3 Review points are only earned for your first ten activity reviews each month. If you experience the same activity multiple times within a month and leave reviews, only the first review will earn points.

9.1.4 Hopetrip points earned in the first year will expire on the last day of the following year. For example, if you earn points on October 1, 2023, and those points remain unused by December 31, 2024, they will be automatically deducted from your account. Please note: All points accumulated in your Hopetrip account as of September 25, 2024, that are still unused, will expire on December 31, 2024, without further notice from Hopetrip.

9.1.5 Paying postage or handling fees on Hopetrip will not earn Hopetrip points, and points cannot be used to offset postage or handling fees.

9.2 Hopetrip Promo Codes

9.2.1 Hopetrip promo codes are one-time use codes, sent to you via email or directly deposited into your Hopetrip account. You can use promo codes to enjoy booking discounts when booking on the Hopetrip platform. Please note that if a promo code has already been used when booking on Hopetrip, it cannot be refunded or returned, even if the user requests a refund or encounters any other circumstances.

9.2.2 Hopetrip promo codes can be obtained through the following methods:

(a) As described in Section 11, you may receive a Hopetrip promo code through an invitation program; or

(b) Hopetrip may grant you a Hopetrip promo code for various reasons at its sole discretion.

9.3 Abuse of Discounts

9.3.1. In any event that Hopetrip discovers that you have obtained Hopetrip points or Hopetrip promo codes through fraudulent means, in violation of these Terms of Use, or in any other manner not agreed to by Hopetrip, Hopetrip reserves the following rights:

(a) To immediately terminate your Hopetrip account; or

(b) To cancel all previously obtained Hopetrip points or Hopetrip promo codes; or

(c) To refuse to provide you with services; or

(d) To handle the matter in any other manner that Hopetrip deems reasonable.

10. Referral Program

10.1 Program

10.1.1 Hopetrip may offer members the opportunity to receive offers or discounts on select sites of its website. Members will receive a referral bonus when they invite a friend to become a Hopetrip member through authorized referral channels and successfully book (e.g., through the Hopetrip website, Facebook, or other Hopetrip social media channels).

10.2 Conditions

10.2.1 You can only receive referral bonuses through authorized Hopetrip member referrals. Invitations made outside of authorized channels will not receive any referral bonuses. You understand that referral bonuses are non-transferable, non-auctionable, non-tradeable, and non-shareable with other members.

10.2.2 You will only receive a referral bonus when your friend completes their first valid booking on the Hopetrip website through an authorized channel because of your invitation. If your friend does not accept the invitation as instructed in the invitation email or other valid referral method, you will not receive the referral bonus, and Hopetrip will not be responsible for this.

10.2.3 You agree that holding multiple Hopetrip accounts is a breach of these Terms of Use, and that sending invitations to other email addresses or accounts, or otherwise attempting to circumvent Hopetrip's referral program system, may result in the loss of your membership and all referral offers in your account. These actions will not affect Hopetrip's other rights or other remedies.

10.2.4 You may not promote our referral program on your own initiative. You may not engage in any promotional, marketing, or other advertising activities on behalf of Hopetrip, including the use of any Hopetrip trademarks.

10.2.5 If we suspect that an invitee or referral offer has been obtained fraudulently, in violation of these Terms of Use, or otherwise not agreed to by Hopetrip, Hopetrip has the right to cancel the invitee's membership and any referral offers obtained by the invitee.

10.2.6 After an eligible invitee successfully books an activity for the first time, Hopetrip will send the referral offer to your account within approximately 24 hours.

10.2.7 Based on each user's usage behavior, hopetrip reserves the right to modify the details of the hopetrip Invite Friends Program offers.

10.2.8 hopetrip has the right to adjust or terminate the Invite Friends Program at any time. Participants must fulfill any tax liabilities arising from the accumulation and/or use of Invite Friends offers. You understand that your account may not accurately display the actual Invite Friends offers received, and hopetrip assumes no responsibility for any errors in your account.

Otherwise, you shall be fully liable for any such losses.

12.2 hopetrip Intervention

12.1.2 If necessary, hopetrip will participate in the defense of any claims or legal actions, as well as any settlement negotiation process. You may not make any settlement that may be detrimental to the rights or obligations of hopetrip without the company's prior written permission. hopetrip has the right to take sole defensive and control action against any claims or legal actions.

13. Disclaimer and Limitation of Liability

15.2 Termination Effect

15.2.1 Upon termination of your account, your right to log in to this website, use the services, and access any content will immediately cease.
